PLANNING BOARD REGULAR MEETING
MONDAY, JULY 26, 2004

Chairman Ceil Saunders called the meeting to order at 6:00 pm.  Members present were:  Ceil Saunders, Jim Craig, Jerry Huml, Frank Vance, Bob Smith, Robert Conrad and Eddie Barber.  Also present were Kevin Reed, Planning and Inspections Director and Kim Haut, Permit Technician/Administrative Assistant.

A motion was made by Jim Craig to approve the minutes of the June 28, 2004 Board meeting.  The motion was seconded by Frank Vance and passed unanimously (6 to 0). 

Kevin Reed, advised the Board members of the Town Board of Commissioner’s agenda items following its July 13, 2004 meeting.  Mr. Reed revisited the idea that sometime ago, the Town Board of Commissioners asked the Planning Board to look at a variety of issues with regards to the Dunes and Vegetation Ordinance.  Mr. Reed reminded the Planning Board members that they did come back with a number of wholesale changes and agreed to look in more detail at possible future changes or changes to that ordinance itself.  Mr. Reed advised the Planning Board that he would be more than happy to make arrangements for everyone to get together again and go over their ideas.

Mr. Reed advised that for the month of June the Planning and Inspections Department had issued a total of 13 permits for new homes and a total estimated value in excess of $2.2 million.  This brings the fiscal year total to over $37 million and the department has collected approximately $262,000 in fees.

Consider a possible amendment to Section 19-71 of the Zoning Ordinance, which regulates the exterior color of new and existing commercial structures.  Mr. Reed presented a wide-range color chart that was not manufacturer specific.  Mr. Reed suggested that each member take the color chart and mark it individually, with their particular choices, and return it when finished.  Mr. Reed will come back with a color chart that incorporates each member’s final choices.  After much discussion a motion was by Jim Craig to table the matter until the next meeting.  The motion was seconded by Frank Vance and passed unanimously (6 to 0).

Discussion on possible amendment to Section 19-225, Paragraph (i) of the Zoning Ordinance which dictates the design standards for dead end streets located in recreational vehicle parks. Mr. Reed presented the proposed amendment to the Planning Board members that essentially states; if you have a street that is designed to be permanently closed then it shall have a turn-around to provide adequate access for emergency vehicles as approved by the Town of Emerald Isle Fire Department.  A motion was made by Jim Craig to recommend to the Board of Commissioners that the amendment be approved.  The motion was seconded by Robert Conrad and passed unanimously (6 to 0).

Discussion on a possible amendment to the Zoning Ordinance in order to establish a Bogue Field Air Installation Compatible Use Zones (AICUZ) Overlay District as part of the Eastern Carolina Joint Land Use Study (JLUS) implementation process.

Mr. Reed presented the Planning Board with a number of zoning techniques and land use restrictions that could be implemented within the AICUZ for Bogue Field.  Six major points were discussed at length between Mr. Reed and the Planning Board members.  Following discussion of the item, the Board was in agreement that a Bogue Field AICUZ Overlay District should be created and some zoning and land use regulations should be in lace for the District.  A motion was made by Jerry Huml to direct staff to prepare the necessary amendments which would include five of the six major points.  The motion was seconded by Eddie Barber and passed unanimously (6 to 0).  

Discussion on the rezoning of certain properties from Residential Motel/Hotel (RMH) to Residential 2 (r-2) as part of the 2004 CAMA Land Use Plan implementation process.  Mr. Reed informed the Planning Board that he had been looking at the various ways to meet the statutory requirements of advertising public hearings that might be better mailing each property owner a letter.  The primary reason for this research was to implement a recommendation of the 2004 Land Use Plan which called for certain areas that are zoned RMH and to be rezoned to R-2.  Since no good alternative to the mass mailing could be found, Mr. Reed informed the Planning Board a letter would be sent to each property owner.  It was suggested that be done in small phases rather then all areas at once.  Mr. Reed told the members he would bring back a compiled data base of property owners for the first phase and then the Board could begin the rezoning process.  No action was required at this time.

COMMENTS:

Chairman Ceil Saunders asked for any comments among the Planning Board Members. 

Bob Smith had concerns due to the rain the last couple of days. The east end of town, particularly 9th through 16th streets, seems to have large amounts of gravel, sand, and mud washing out in to the street.  Mr. Smith wanted to know who would be responsible for cleaning it up.  Mr. Reed informed Mr. Smith was the Department of Public Works responsibility and he would be happy to relay his concerns to Artie Dunn with Public Works.

There being no further business before the Board, a motion was made by Frank Vance to adjourn.  The motion was seconded by Jim Craig and passed unanimously (6 to 0).  Meeting was adjourned at 7:10pm.
