SUBJECT: Exterior Commercial Color Review – Bogue Inlet Pier House - (Summary & Suggested Motions)
The Board of Commissioners is scheduled to review a proposed new exterior color for the new Bogue Inlet Pier House currently under construction. Mike Stanley, owner of the pier, previously received approval for a “custom orange” color, which was identical to the old pier house and restaurant, but is now seeking approval for the use of “banana pepper green”.
The attached memo from Josh Edmondson, Town Planner, includes a thorough discussion of this request, which was endorsed by the Planning Board by a 3-1 vote. Color samples are also attached.
As you know, the Board has considered several exterior commercial color reviews in recent years, and all but one have been approved. The Board may wish to consider the utility of this ordinance requirement in the future, and may wish to direct the Planning Board to reconsider this requirement. There are likely three schools of thought that apply to this ordinance:
the Town should aggressively control exterior commercial color schemes to promote general uniformity throughout the business district with “earth-tone colors”, in order to maintain community aesthetics,
the Town should not be regulating exterior commercial color schemes, and should leave this decision to the business owner, and/or
the Town should utilize the existing ordinance as a “fail-safe”, by providing significant discretion in color choice for business owners, but retaining formal approval authority to guard against particularly egregious and offensive exterior color schemes.
In recent years, the Board has generally taken an approach consistent with #3 above, the “fail-safe” approach, and has considered the type of business, the business location, and the surrounding area. After considering these factors, the Board previously approved the use of “custom orange” for the Bogue Inlet Pier House.
