SUBJECT:       Ordinance Amending Chapter 9 – Nuisance Abatement – of the Code of Ordinances Regarding Offensive Lighting - (Summary & Suggested Motions)

The Board of Commissioners is scheduled to consider the attached ordinance amendment that would specifically prohibit the projection of light from private properties in a manner that creates unsafe vehicle and pedestrian conditions or creates a nuisance for adjacent property owners. 

The attached ordinance amendment was drafted by Police Chief Tony Reese and Town Planner Josh Edmondson, and is intended to provide proper legal standing for Town staff to resolve these types of concerns.  As is the case with most less serious ordinance violations, Town staff first seek to resolve the concerns in a cooperative manner, however, if cooperation is not forthcoming from the offender it is sometimes necessary to take formal enforcement action.  The attached ordinance amendment would provide Town staff with a stronger tool to resolve these concerns in the future.

The proposed penalty for a violation of this ordinance is a $100 civil penalty. Citations would only be issued in situations where the offender is not cooperative in resolving the concern.  

Police Chief Reese will be present at the April 10 meeting to discuss the proposed ordinance amendment and answer any questions
