NOTICE IS HEREBY GIVEN that the Planning Board’s regular meeting scheduled for Monday, September 24, 2018 at 6 pm has been CANCELLED. The next regularly scheduled Planning Board meeting will take place according to the regular meeting schedule on Monday, October 22, 2018 at 6 pm in the Emerald Isle Town Board Meeting Room, 7500 Emerald Drive, Emerald Isle, NC.

Public Hearing Notice
Resolution of Intent to Close Easement
5200 Block, Between Ocean Drive and Emerald Drive
WHEREAS, a public easement is located between Ocean Drive and Emerald Drive in the 5200 block, and has never been improved or open to the public, and
WHEREAS, it appears this easement was initially intended to be used for public access between Emerald Drive and Ocean Drive to enable a pathway to a public beach access located on the south side of Ocean Drive in this area, and
WHEREAS, Elizabeth Street, a public street, is located approximately 113 feet east of this easement, and is commonly used by pedestrians to reach the nearby public beach access, and
WHEREAS, this easement is 12.5 ft. wide and approximately 380 feet long, and is bordered by 2 parcels to the west and 4 parcels to the east, and
WHEREAS, all adjacent parcels have primary access to Emerald Drive, Elizabeth Street, and/or Ocean Drive, and
WHEREAS, the 2 adjacent parcel owners to the west are requesting the legal closure of this easement, and
WHEREAS, if this easement is closed then one-half of the easement width (6.25 feet) would revert to the 2 adjacent parcels owners to the west, and one-half of the easement width (6.25 feet) would revert to the 4 adjacent parcel owners to the east,
NOW, THEREFORE, BE IT RESOLVED by the Emerald Isle Board of Commissioners that
- The Town hereby declares its intent to close an approximately 380 ft. long, 12.5 ft. wide public easement located in the 5200 block between Ocean Drive and Emerald Drive, and hereby calls for a public hearing to be held on Tuesday, October 9, 2018 at 6 pm regarding the possible closing.
- This resolution shall be published once a week for 4 consecutive weeks, a copy sent by certified mail to all owners of property adjoining the easement as shown on Carteret County tax records, and a copy shall be posted prominently in at least two places along the easement.
- The Board of Commissioners will hear comments regarding the possible closing, and if the closing is not detrimental to the public interest and no property owners will be denied reasonable ingress and egress to their properties, the Board may adopt an order permanently closing this easement.
